Petitioner, a native and citizen of Mexico, petitioned for assessment of the BIA’s order of elimination locating that his convictions for indecent exposure and making terroristic threats underneath Texas law are crimes related to ethical turpitude (CIMT). The court concluded that the BIA incorrectly applied the sensible chance approach in reading whether petitioner’s convictions are CIMTs.
There has no longer been an intervening change of regulation that would permit this panel to overturn prior precedent and adopt the realistic chance approach as applied to CIMTs. The court has consistently implemented the “minimal reading” method in this context. Accordingly, the court docket reversed and remanded for the BIA to analyze petitioner’s convictions underneath the best method.
